These Terms and Conditions govern your access to and use of Social Genie, including our website, dashboard, AI tools, social media automation features, review management features, support services, and related products. By creating an account, starting a trial, connecting a social channel, or using Social Genie, you agree to these Terms.

1. The Service

Social Genie is an AI-powered social media management platform that helps businesses create content, schedule posts, manage customer conversations, capture leads, monitor reviews, analyze engagement, and collaborate with team members. Features may vary by plan, workspace, integration availability, region, and product release status.

2. Eligibility and Accounts

You must be legally able to enter into a binding agreement and use Social Genie for business or professional purposes. You are responsible for keeping your login credentials secure, maintaining accurate account information, and all activity that occurs under your account or workspace.

If you create or manage a workspace for an organization, you represent that you have authority to accept these Terms on behalf of that organization. You are responsible for users, team members, permissions, and content associated with your workspace.

3. Trials, Plans, and Billing

Social Genie may offer free trials, monthly plans, annual plans, usage limits, discounts, or promotional pricing. Trial and plan details displayed at signup or checkout form part of these Terms.

Except where required by law or expressly stated in writing, fees are non-refundable once a paid billing period begins.

You retain ownership of content, business information, brand materials, messages, reviews, prompts, and other materials you submit to Social Genie. You grant Social Genie a limited license to host, process, display, transmit, modify, and use your content as necessary to provide, secure, support, and improve the service.

You are responsible for the accuracy, legality, permissions, and rights associated with your content and for reviewing content before it is published. You must ensure that your use of Social Genie complies with advertising rules, consumer protection laws, privacy laws, industry regulations, and platform policies that apply to your business.

6. AI-Generated Output

Social Genie uses AI to create drafts, replies, recommendations, summaries, sentiment insights, and other outputs. AI output may be inaccurate, incomplete, outdated, similar to output generated for others, or unsuitable for a specific use case. You are responsible for reviewing and approving AI-generated content before relying on it or publishing it.

Social Genie does not provide legal, financial, medical, compliance, or professional advice. Do not rely on AI output as a substitute for qualified professional review where such review is required.

7. Connected Platforms and Third-Party Services

Social Genie may integrate with social networks, messaging platforms, review sites, analytics tools, payment processors, email providers, AI providers, and other third-party services. Your use of those services remains subject to their own terms, privacy policies, permissions, rate limits, and technical restrictions.

We are not responsible for third-party services, platform outages, API changes, account restrictions, rejected posts, removed content, lost access, or other issues outside our reasonable control. You can revoke connected platform access through the relevant platform or available Social Genie settings.

8. Privacy and Data Protection

Our collection and use of personal information is described in our Privacy Policy. By using Social Genie, you agree that we may process information as described there and as needed to provide the service.

9. Service Availability and Changes

We aim to keep Social Genie available and useful, but we do not guarantee uninterrupted, error-free, or permanent availability. We may update, improve, suspend, limit, or discontinue features at any time. We may also perform maintenance, apply security fixes, or change integrations when required by technical, legal, business, or platform requirements.

10. Intellectual Property

Social Genie, including its software, design, branding, workflows, documentation, logos, and underlying technology, is owned by Social Genie or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Social Genie intellectual property to you.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of Social Genie except as expressly allowed by us in writing or by applicable law.

11. Suspension and Termination

You may stop using Social Genie or request account closure at any time. We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay applicable fees, misuse the service, or if continued service provision is no longer commercially or legally practical.

After termination, your right to use Social Genie ends immediately. Certain sections of these Terms will continue to apply, including payment obligations, ownership, disclaimers, limitations of liability, and dispute provisions.

Social Genie is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation. We do not guarantee specific engagement, revenue, lead, follower, ranking, review, or marketing outcomes.

13. Limitation of Liability

To the fullest extent permitted by law, Social Genie will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, or cost of substitute services.

To the fullest extent permitted by law, our total liability for all claims relating to the service will not exceed the amounts paid by you to Social Genie for the service in the three months before the event giving rise to the claim, or USD $100 if you have not paid for the service.

14. Indemnity

You agree to defend, indemnify, and hold harmless Social Genie from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of the service, your connected accounts, your violation of these Terms, or your violation of laws, regulations, platform policies, or third-party rights.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and may provide notice through the website, dashboard, or email. Continued use of Social Genie after changes take effect means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Social Genie operates, without regard to conflict of law rules, unless mandatory local law provides otherwise.
